§ 1 Scope, Customer Information
The following terms and conditions describe the contractual relationship between Nadelheit Sabine Gräftner and consumers who buy our products through our internetshop respectively Dawandashop. These Terms contain additional customer information to the BGB Civil Code-Info regulation of Germany. The contract language is German.
§ 1 Conclusion of contract and rescission
We undertake the duty to serve orders from our contractors, which have been purchased by using our internetshop respectively Dawandashop under the terms and conditions here in after. In the case of writing, printing and calculation errors, we have the right to rescission without giving the parties any claims.
§ 2 Statement of Privacy
Your personal information (eg title, name, address) will be used by us in accordance with the provisions of German data protection law. The following rules describe the nature, extent and purpose of the collection, processing and use of personal data. This privacy statement applies only on processing within the area of our direct control. If you are directed via links on our pages to other pages please inform yourself about the handling of your data. Furthermore we don't overtake any liability for handling personal data by Dawanda, their systems or employees. As well we overtake no liability for the handling of personal data by Paypal or other systems used for handling the payment. Your personal data, as far it is necessary for the establishment, content or modification of the contractual relationship (inventory data), may only be used for contract execution. This must be e.g. as to deliver the goods, your name and address must be passed to the carrier of the goods. Without your express agreement or without legal basis, we don't pass your personal information to third parties outside the necessary contractual execution. By order of the competent authorities we give in each case, information on inventory data, as necessary for purposes of prosecution, protection against threats by the police authorities of the countries to fulfill the statutory duties of the constitutional protection authorities of the federal and state governments, the Federal Intelligence Service or the military or for the enforcement of intellectual property required. § 3 Storage of purchase information
Purchase information with details of the item are not stored by us but you can see the details in Dawanda after the conclusion.
Input data mistakes: Input dada mistakes during purchasing at our internet shop respectively Dawandashop can be corrected until you have clicked the button to complete the purchase order and getting liable for paying costs. Then your purchase become legally binding.
§ 5 Reshipment costs in the event of cancellation
You have to bear in the event of cancellation the cost of reshipment if the delivered goods ordered and if the price of the item to be returned does not exceed the amount of 40, - €, or if the price is higher and we have not yet received an agreed partial payment at the time of the cancellation. You have to pay only the regular cost of the return. Additional costs, for example, which caused by a change in our business office or through our desired use of expensive transport services, are at our expense.
§ 6 Warranty
The guarantee is governed by the law.
§ 7 Limitation of Liability
We exclude liability for negligent breach of duty unless they relate to essential contractual obligations, damages resulting from injury to life, body or health, or guarantees, or claims under the Product Liability Act. The contractual obligations include, in particular the obligation to deliver the item without material and legal defects.
